First, take a picture. Many times, a slip and fall case fails simply because the injured person does not know what caused a fall. This is especially important when a fall is caused by a liquid on the floor. After a short time the liquid may evaporate or the business might ask an employee to clean the liquid up. When you fall at a business, take a moment to look around and figure out what caused you to fall, and take a picture.
Second, ask for the name, address, and phone number of any person who saw you fall. In some cases, having a witness to a fall can make all the difference. Often times, jurors decide a slip and fall case based on who they believe, the injured person or the business owner. When a witness agrees with the injured person’s statement of what happened, that testimony can tip the balance in favor of the injured person.
Third, ask someone from the business to fill out an incident report and make sure the report includes the names of any witnesses. Ask the business owner if you can have a copy of the incident report. The business owner doesn’t have to give you a copy, but it doesn’t hurt to ask. Sometimes, business owners do not know that someone was injured on their property. Employees of the business are often nervous that the owner could punish them for allowing a fall to occur. Having an incident report lets the owner know that you were hurt and also shows that you were at the business.
Finally, if you are hurt, seek medical attention as soon as possible. The longer you wait to seek medical attention, the more opportunities you provide the business owner to argue that you some other accident caused your injuries. If you seek immediate medical attention for your injuries, it will be much more difficult for the business owner to make that argument.
